You can be charged with shoplifting in Massachusetts even if you have not left a retail store with merchandise. Massachusetts General Laws Chapter 266, Section 30A, defines shoplifting using broad and inclusive language. You can be arrested and prosecuted if you intentionally:  

Take or Carry Away: Removing items from the store without paying.  

Conceal Merchandise: Hiding an item in your pocket, purse, or backpack while still inside the store.  

Alter or Switch Price Tags: Swapping a tag from a cheaper item onto a more expensive one.  

Transfer Containers: Taking an item out of its original packaging and putting it into a different box or container to avoid paying full price.  

Steal a Shopping Cart: Removing a cart from the store’s premises with the intent to keep it.  

The $250 Shoplifting Threshold

In Massachusetts District and Boston Municipal Courts, shoplifting goods under $250 are treated as a lower-level misdemeanor. A first offense under $250 is punishable by a $250 fine; however, subsequent offenses can carry jail time. If the value of the goods is $250 or more, the penalties jump significantly, punishable by up to 2.5 years in a House of Correction and a $1,000 fine.  

Shoplifting vs. Larceny: What is the Difference?

The $250 threshold above applies only to a shoplifting charge. However, the same conduct or incident can also be charged under other Massachusetts criminal laws, including larceny. Police and prosecutors frequently choose to charge retail theft under the broader Massachusetts Larceny statute (M.G.L. c. 266, § 30), especially if the value of the goods is higher.

Larceny Under $1,200 (Misdemeanor): Theft of property valued under $1,200, is a misdemeanor. However, it still carries a maximum penalty of up to 1 year in jail and fines up to $1,500.  

Larceny Over $1,200 (Felony): Theft of property exceeding $1,200 in value is elevated to Felony Larceny Over $1200. A felony conviction is life-altering and is punishable by up to 5 years in State Prison or up to 2 years in jail, alongside massive fines and serious consequences to your record and future.
