Gardner District Court

The Gardner District Court serves a group of small towns in northern Worcester County, a rural catchment where most criminal matters are first offenses and most begin by summons. The Worcester County District Attorney’s Office prosecutes its docket, and the character of that docket, first-time defendants, summons cases, and motor vehicle matters, means the clerk-magistrate stage is where much of the real work is done. Attorney Joe Serpa prepares each case as a matter to be ended before it becomes a record.

A dismissal here can come from the prosecutor or from a specific legal ground raised by the defense, such as a lack of probable cause or a denied clerk-magistrate hearing. The firm’s page on how criminal cases get dismissed in Massachusetts lays out each path.

Location and Access. The Gardner District Court, 108 Matthews St., Gardner, MA 01440, sits off Route 2 and Route 68 with parking at the courthouse. The court’s phone is (978) 632-2373.

Communities Served. Gardner, Hubbardston, Petersham, and Westminster.

The Clerk-Magistrate Hearing. A large share of Gardner’s business begins at the show cause hearing under G.L. c. 218, § 35A, where a magistrate decides whether a complaint issues and a denial ends the matter with no arraignment and no CORI entry. These are prepared as documentary presentations that test whether the report makes out every element.

OUI and Motor Vehicle Cases. Route 2 supplies the OUI and motor vehicle calendar, defended on the stop and the device records, with the four-day citation rule in play.

Drug and Domestic Violence Calendars. The court carries drug matters litigated at the suppression stage and domestic violence and 209A sessions, each defended on its elements.
