Leominster District Court

The Leominster District Court serves the north-central Worcester County city of Leominster and its neighbors, a working population for whom a criminal charge threatens the job and the license as much as the penalty. The Worcester County District Attorney’s Office prosecutes its docket of OUI, drug, motor vehicle, theft, and domestic violence matters. Attorney Joe Serpa defends each case with the collateral consequences mapped from the first call and prepares it as a matter to be ended at the earliest stage.

Wherever a Massachusetts case is prosecuted, the rules on when a judge can dismiss it are the same. See who controls a dismissal and the grounds a judge can act on without the prosecutor’s agreement.

Location and Access. The Leominster District Court, 25 School St., Leominster, MA 01453, sits near Route 2 and Route 12 with parking at the courthouse. The court’s phone is (978) 537-3722.

Communities Served. Leominster, Holden, and Princeton.

OUI and the Route 2 Corridor. Route 2 supplies the OUI calendar, defended on the stop, the field tests, and the breath-test records, with the four-day citation rule in play on cases that begin without an arrest.

Drug and Search Litigation. The court’s drug matters are litigated at the suppression stage by motion to suppress under Article 14.

Domestic Violence and Theft Calendars. The court runs its domestic violence and 209A sessions and a retail theft calendar, defended on the elements with self-defense and restitution addressed where they apply.

The Clerk-Magistrate Session. A large share of the court’s business begins at the show cause hearing under G.L. c. 218, § 35A, where a denial ends the matter with no record.
